Elon Musk's legal battle with the Labor Relations Board over his aerospace company SpaceX has been "unreasonable" due to a lack of convincing arguments, Jennifer Abruzzo, the Labor Relations Board's chief attorney, said on Wednesday.

"If the law isn't on your side and the facts aren't on your side, then bang on the table and yell. That's what I feel like Elon Musk is doing," Abruzzo said.

In January, Abruzzo's office issued a complaint accusing SpaceX of unlawful retaliation by firing eight employees who circulated a letter criticizing Musk. SpaceX responded the next day, suing the National Labor Relations Board, saying its structure and procedures were unconstitutional.

Abruzzo said Wednesday that the eight employees were fired for "actually raising issues about their horrific, misogynistic, sexist comments and actions."
