Musk's ex-girlfriend Grimes made headlines this week when she sued Musk for custody of their three children. But court documents show Musk first quietly sued Grimes last month. Musk sued Grimes on September 7 for seeking a relationship and access to his children, accusing Grimes of moving to California to escape the jurisdiction of Texas courts.
Musk said in the complaint that he believes the custody dispute will be resolved, but if it cannot, he hopes a Texas court will intervene. His case was served on September 13 to Grimes, who subsequently filed a lawsuit against Musk on September 29. Grimes' lawsuit seeks physical custody of the children and includes a "standard restraining order" to prevent either parent from taking the children out of California.
Musk claimed that disclosing information about the case "would jeopardize the health, safety or liberty" of him, Grimes and their children. The case would be difficult for outsiders to spot because the children's names are not used in the parties' complaint, with Musk's name replaced by his middle initial "R" and Grimes' first name replaced by an "E." A court official said the hearing was originally scheduled for Friday but was canceled after the parties agreed to keep it confidential.
