Recently, a Lalamove driver in Shandong encountered a strange thing: The "goods" the customer asked him to transport turned out to be a corpse, so he refused. The customer said, "How about giving you some extra money." After the driver refused many times, the customer actually complained and threatened. In response, Lalamove staff responded that Lalamove’s vehicles could not meet the conditions for transporting corpses and suggested that customers choose a suitable platform for transportation.
The driver should negotiate with the customer,There is no further liability after normal cancellation of the order.
If the customer insists on making a complaint, the system will give the driver a reminder of the fault after testing. The driver can appeal, and the appeal will be handed over to the staff for further review."After the review, if it can be determined that the fault was not caused by the driver, the judgment can be revoked and it will not have any impact on the driver."
Some lawyers pointed out that according to relevant regulations on funeral management, commercial corpse transport vehicles and other funeral equipment must meet the technical standards stipulated by the state. No unit or individual may provide body transportation services without approval.
In addition, the relationship between the carrier driver and the shipper customer is a transportation contract, and both parties should reach an agreement on their rights and obligations. If the relevant matters do not comply with relevant legal provisions, or the carrier has not been informed of the specific matters of transportation in advance, and the carrier does not have the transportation qualifications and conditions, the platform should not hold the carrier responsible.
On the contrary, if the carrier transports remains in violation of regulations, causing disruption to public order, endangering public safety, and infringing upon the legitimate rights and interests of others, the competent authorities shall stop it. If other consequences occur, the carrier shall bear liability according to its behavior and consequences.
In fact, Article 13 of the "Funeral Management Regulations" that came into effect in 1997 has clearly stipulated:"Except for special circumstances, the transportation of corpses must be handled by the funeral home, and no unit or individual may handle it without authorization." "Private transportation of corpses is strictly prohibited."
