Among them, Zhang Moumou’s trademark application was withdrawn in May this year and is currently invalid. Guangzhou Meicheng’s trademark application was rejected in August this year.
Guangzhou Meicheng applied to register the "Hong Kong Meicheng" trademark in October 2022, but the trademark application has been rejected.
In January 2024, the trademark rejection review decision showed that the applicant was dissatisfied with the rejection of the "Hong Kong Meicheng" trademark registration application No. 67778635 and applied for review.
After review, it was considered that the applicant was not from Hong Kong and could easily cause misunderstanding to the relevant public.At the same time, the "Hong Kong" contained in the applied trademark word "Hong Kong Meicheng" is the place name of an administrative division at or above the county level in my country, and has no other meaning different from the name of an administrative division. Although the applicant claims to give up the exclusive right to "Hong Kong", the relevant public cannot naturally know the relevant circumstances of the surrender of exclusive rights in the applied trademark, and will still identify the "Hong Kong" part of the applied trademark.
At present, the Guangzhou Huadu District Market Supervision and Administration Bureau has issued a report on the situation involving Meicheng mooncakes, which mentioned that Guangzhou Meicheng Technology Company has obtained a business license and a food production license.
Hong Kong Meicheng Food Group has registered trademarks such as "Meicheng", "Hong Kong Meicheng Mooncake" and "MEISUN" in Hong Kong that have been approved for mooncake products. It has authorized the use of the trademarks to Guangzhou Meicheng Food Company.
Guangzhou Meicheng Food Company entrusts Guangzhou Meicheng Technology Company to process "Hong Kong Meicheng Mooncakes" products. There is an entrusted processing contract. Product packaging materials are provided by Guangzhou Meicheng Food Company. The words "Hong Kong Meicheng Mooncakes" are used on the outer packaging and text promotion of related mooncake products.
