According to Bloomberg, according to the latest ruling by a US judge, Elon Musk failed to prevent Sam Altman from reorganizing OpenAI. It's another blow for Musk, who had previously been rejected for a $97 billion bid to buy the nonprofit that controls OpenAI.
U.S. District Judge Yvonne Gonzalez Rogers on Tuesday rejected Musk's request to issue an injunction to halt OpenAI's transformation from a nonprofit organization to a more traditional public benefit for-profit company. Altman criticized Musk's acquisition attempt as an attempt to slow down OpenAI's development and prevent it from competing with Musk's own startup xAI.
Rogers said in his ruling that Musk failed to meet "the burden of proof to claim extraordinary relief." But she also wrote that she would allow Musk to pursue a lawsuit against OpenAI, as she hinted at the Feb. 4 hearing.
The legal dispute began last year. At the time, Musk accused OpenAI of straying from its founding mission as a charitable organization, accepting billions of dollars in investment from Microsoft, and seeking to monopolize the generative artificial intelligence market.
