recently,Chen Li, a Guilin citizen, successfully defended her rights for more than three years. After a retrial, the People's Court of Rushan City, Shandong Province revoked the original judgment and rejected all demands from creditors requiring her to bear a debt of more than 1.03 million yuan. The dispute arose from the unauthorized use of a copy of Chen Li's ID card. She once worked for a hotel management company in Beijing, and left her job in 2017 to return to Guilin.

Wang, the former legal representative of the company, secretly used the copy of her ID card to register her as a shareholder of the company under her false name.

At the end of 2022, Chen Li's bank cards, vehicles and real estate were suddenly seized by the court, and she was sentenced to be jointly and severally liable for the debts of a canceled company.

Chen Li was very puzzled by this. She had never signed a shareholder agreement, nor participated in any operation, investment or dividend distribution.

Due to Wang's deliberate concealment, the court of first instance failed to effectively serve the litigation documents, and the court heard the case in absentia through an announcement, and ruled that Chen Li should jointly bear a million-dollar debt.

After repeated appeals to no avail, Chen Li entrusted a lawyer to apply for a protest to the procuratorial organ.

The lawyer's verification found that Chen Li's signatures in the industrial and commercial registration were all forged. She had not contributed capital, operated the business, or distributed dividends. She was a typical shareholder who was impersonated.

Moreover, the company involved in the case is a joint-stock company, and the persons responsible for cancellation without liquidation are directors, controlling shareholders, etc., not ordinary shareholders. The applicable law in the original trial was obviously wrong.

The Rushan City Procuratorate adopted the legal opinion and issued procuratorial recommendations for retrial to the court.

After the court launched a retrial, it was found that Chen Li was no longer a registered shareholder, director, or actual controller, and should not be held responsible according to law.

In the end, the retrial changed the sentence, and Wang's heirs were required to repay the debt within the scope of the inheritance, completely clearing Chen Li's innocence. This case has also sounded the alarm for the majority of working people.

Lawyers remind you that when providing a copy of your ID card, you must clearly indicate "for XX purposes only" and try to avoid giving the original ID card to others for safekeeping.

Once you discover that your identity has been fraudulently used, you should collect evidence as soon as possible and protect your rights and interests through legal means.
