The person involved is Beijing Aoland Information Technology Co., Ltd. The company operates a website promoting a piece of software called the DeepSeek local deployment tool.
However, this company has no official relationship with DeepSeek. According to law enforcement agencies, neither Outlander nor the developer of this software has any relationship with Deep Search Company.
Outlander directly used the word DeepSeek and the official icon on the download page, charging page, installation page and other places of the software involved.
In addition, this company also spends money on bidding ranking advertising, and uses DeepSeek's popularity to intercept traffic on search engines such as Baidu. The first thing users see when searching for DeepSeek may be this copycat product.
Beijing Chaoyang District Market Supervision Bureau relied on digital forensics technology and used blockchain forensics to fix all illegal evidence, and used reasoning-style law enforcement documents to explain the illegal circumstances and penalty discretion to the parties in detail.
The law enforcement agency finally determined that Outlander had used user information barriers to free ride on the word DeepSeek to earn traffic popularity, and ordered it to immediately stop illegal activities and fined it 5,000 yuan.
This is not an isolated case. Among the five typical cases of unfair competition in the AI field announced by the State Administration for Market Regulation during the same period, a company in Hangzhou was also fined 30,000 yuan for confusing the DeepSeek trademark, and many other cases involving ChatGPT were investigated and punished.
The implementation of the country’s first AI confusion fine has drawn a clear red line for commercial competition in the AI field, and supervision of free-riding in AI hot spots has officially entered regular enforcement.
