Previously, while visiting a scenic spot in Qijiang, Chongqing, a man Liu Moumou left the tourist trail and entered the bamboo forest to dig bamboo shoots. He accidentally stepped on the ground and fell. The sharp bamboo shoots penetrated his nose, causing serious injuries.Afterwards, he sued for more than 36,000 yuan on the grounds that the scenic spot failed to fulfill its safety guarantee obligations. The court ultimately rejected all his claims.

In October 2025, Liu bought a ticket to enter the scenic spot for a visit. On the way, he left the trail without authorization and entered the bamboo forest. When he saw the bamboo shoots sprouting, he dug them privately.

On the way back, he accidentally tripped over a bamboo shoot and landed on his face, causing the bamboo shoot to pierce his nasal cavity. He was diagnosed with a penetrating nasal injury, nasal septum and sinus fractures, etc. He was hospitalized for nine days and spent more than 20,000 yuan in medical expenses.

Liu Moumou believes that the ground in the scenic area is messy, the bamboo shoots are exposed and there is no protection, and he should bear the liability for compensation.

However, the scenic spot argued that the injured was not injured in the tourist area, but illegally entered the non-tourist area to dig bamboo shoots. The scenic spot has clearly prohibited the extraction of bamboo shoots at the entrance and along the way. The natural landscape cannot install protection for every bamboo shoot, and the accident was caused by the injured person's own violation.

The court found that the scenic spot had set up standardized trails and warning signs to fulfill its reasonable safety obligations.

As an adult, Liu Moumou left the road without authorization and dug illegally, which was the entire cause of the accident; the scenic spot provided timely rescue after the incident and was not at fault.

The court finally ruled to reject all its claims and the case acceptance fees shall be borne by itself.

The judge in charge said that the scenic spot is not a safety deposit box with unlimited liability, and tourists are the first person responsible for their own safety.

Scenic spots within regulated tourist areas have the obligation to protect them, but tourists who take risks without permission or violate rules must bear the consequences themselves.
