It was easy to damage some valuable and fragile items, and it was impossible to effectively protect rights. In this regard, the government has now issued special regulations, which clearly stipulate that throwing and trampling express delivery is not allowed.According to the website of the Ministry of Transport, the "Express Delivery Market Management Measures" were adopted at the 28th Ministry Meeting on December 8, 2023, and are now announced and will come into effect on March 1, 2024.
It stipulates that the safety of express items should be ensured, express items should be prevented from being lost, damaged, or lacking internal parts, and express items should not be thrown or trampled on;Except for force majeure factors, the express delivery will be delivered to the receiving address and recipient within the promised time limit as agreed.
The "Express Delivery Market Management Measures" stipulate that enterprises operating express delivery business shall not engage in the following acts:
(1) Knowing that others are engaging in activities that endanger national security, social public interests, or the legitimate rights and interests of others and still cooperate in providing express delivery services;
(2) Illegal fabrication of express delivery service information;
(3) Selling, leaking or illegally providing user information learned during the process of providing express delivery services;
(4) Other behaviors prohibited by laws, regulations and state regulations.
If an enterprise operating express delivery business commits any of the following circumstances, the postal management department shall order it to make corrections, issue a warning or circulate a notice of criticism, and may impose a fine of not more than 10,000 yuan; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 30,000 yuan may be imposed:
(1) Confirming receipt of express mail on behalf of the user without the user’s consent;
(2) Using smart express boxes, express service stations, etc. to deliver express items without the user's consent;
(3) Throwing or trampling on express items.
The revised "Express Delivery Market Management Measures" has 9 chapters and 57 articles. The main contents include: clarifying the safeguard measures to promote the development of express delivery, establishing an institutional orientation for green and low-carbon development, optimizing the regulatory methods of the express delivery market order, strengthening the protection of the rights and interests of consumers using express delivery services, reflecting the institutional requirements for the safe development of express delivery, and improving the institutional means for the governance of the express delivery industry, etc.
