On October 23, a financial magazine reported that Xu Simin, the legal representative, chairman and general manager of Hangzhou Wahaha Group Co., Ltd., had recently resigned. A person close to Wahaha revealed to Sina Finance that the news is true. An old employee who is in labor dispute litigation with Wahaha Group said: "I received a call from the Intermediate People's Court where the case belongs. Since the legal representative of Wahaha Group has resigned, the court date of the case will be changed."
As of now, the industrial and commercial registration information of Hangzhou Wahaha Group has not been updated, and the legal representative is still Xu Simin. Wahaha has no public response to this.
Public information shows that Xu Simin was born in law and served as the director of the legal department of Hongsheng Group and the director of the legal office of Wahaha Group. In October 2025, Zong Fuli resigned as the legal representative, chairman and general manager of Wahaha Group, and Xu Simin was appointed as the general manager of the group; in November of the same year, the industrial and commercial information was changed, and Xu Simin took over as the chairman and legal representative.
According to reports, as for the "real reason for Xu Simin's resignation," a Wahaha employee revealed that it may be related to a new food production regulation that will be implemented at the end of this year. On December 1, 2026, the "Measures for the Supervision and Administration of Food Entrusted Production" promulgated by the State Administration for Market Regulation (SAMR Order No. 113) will be officially implemented.
The new regulations clearly state that the entrusting party shall supervise the production behavior of the entrusted party and be responsible for the safety of the food produced under the entrustment. The entrusted party shall accept the supervision of the entrusting party and be responsible for production activities. The entrusted production recognized by the new regulations refers to "the act of the entrusted party engaging in all or part of the production activities of food in accordance with the requirements of the entrusting party and delivering the produced food."
The employee also said that Xu Simin may have resigned because he was worried about the joint responsibilities of Hongsheng and Wahaha after the implementation of the "Food Entrusted Production Supervision and Management Measures" and was unwilling to take greater risks as the legal representative.
