[The "Two High People's Government and the Ministry of Public Security" jointly issued the "Opinions on Several Issues Concerning the Applicable Law and Other Issues in Handling Criminal Cases Involving Fentanyl-like Substances"] September 23rd, in order to accurately punish crimes involving fentanyl-like substances in accordance with the law, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security jointly issued the "Opinions on Several Issues Concerning the Application of Law and Other Issues in Handling Criminal Cases Involving Fentanyl-like Substances" (hereinafter referred to as the "Opinions"). The "Opinions" adhere to the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, thoroughly implement Xi Jinping Thought on the Rule of Law and the overall national security concept, strictly follow the Criminal Law, Criminal Procedure Law and other relevant legal provisions, provide guidance on several issues such as the application of law in criminal cases involving fentanyl-like substances, emphasize that crimes involving fentanyl-like substances will be severely punished in accordance with the law, and resolutely safeguard the lives and health of the people and social harmony and stability. There are 18 articles in the "Opinions", which mainly clarify the quantitative standards for conviction and sentencing of fentanyl-type substance crimes, and divide fentanyl-type substances into two categories: medicinal and non-medicinal. Medicinal fentanyl-type substances refer to the quantitative standards for fentanyl stipulated in the "Interpretation of Several Issues Concerning the Application of Laws in the Trial of Drug Crime Cases" by the Supreme People's Court, and non-medicinal fentanyl-type substances refer to the quantitative standards for heroin stipulated in the Criminal Law. The "Opinions" also stipulates the scope of fentanyl-like substances, basic requirements for collecting evidence, basic rules for determining knowingness, recovery of illegal income, jurisdiction of related cases, etc., and details the work responsibilities of the three organs of public security, procuratorate, and law in handling criminal cases involving fentanyl-like substances, providing a clear basis for law enforcement and judicial handling of cases. At the same time, the Supreme People's Procuratorate and the Ministry of Public Security also issued the "Regulations on the Standards for the Filing and Prosecution of Fentanyl Substance Crime Cases." In the next step, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security will work together to implement the work, continue to strengthen the legal punishment and comprehensive management of fentanyl-related substance crimes, and continue to promote the high-quality development of anti-drug work.
