[U.S. Department of Defense banned from blacklisting Anthropic] On August 28, the U.S. District Court judge for the Northern District of California ruled on August 27, local time, that the U.S. Department of Defense’s blacklisting of the U.S. artificial intelligence (AI) company Anthropic was illegal. Judge Rita Lin wrote in the ruling: "The undisputed factual record shows that the actions of the U.S. Department of Defense constituted a violation of the First and Fifth Amendments of the Constitution. The factual record further shows that U.S. Secretary of Defense Hegseth's decision to designate Anthropic as a 'supply chain risk' violated the relevant statutory framework... and was arbitrary and capricious behavior. There is no substantive dispute about this." In early March this year, Anthropic was included in the federal government's supply chain risk blacklist for refusing the U.S. Department of Defense's request for unrestricted use of its artificial intelligence technology. The company immediately filed a lawsuit against the U.S. Department of Defense. Rita Lin approved a preliminary injunction that month, preventing the U.S. federal government’s order banning Anthropic’s artificial intelligence technology from taking effect.
