[China Securities Regulatory Commission: Plans to clearly support and encourage the implementation of advance compensation] On October 19th, the China Securities Regulatory Commission drafted the "Guiding Opinions on Advance Compensation in the Securities Market (Draft for Comments)" and is now publicly soliciting opinions. It pointed out that the implementation of advance compensation is clearly supported and encouraged. First, on the basis that the Securities Law stipulates that advance compensation entities have the right to recover compensation, it is further clarified that for the need of recovery, advance compensation entities can obtain advance compensation information from the insurance fund company after advance compensation (Article 15). The second is to clarify that the China Securities Regulatory Commission can use the relevant information of advance compensation as a consideration factor in administrative licensing review, administrative penalty discretion, and securities and futures market integrity supervision and management in accordance with laws and regulations (Article 18).
