[General Administration of Financial Supervision: Trust companies carrying out asset management trust business should fully explain the risks and shall not promise in any form to guarantee principal and return] On October 30, the heads of relevant departments and bureaus of the State Administration of Financial Supervision answered reporters’ questions on the "Asset Management Trust Management Measures". What are the main requirements in the "Measures" regarding asset management trust sales?
Answer: When trust companies carry out asset management trust business, they should fully explain the risks to investors and must not promise in any form to guarantee principal and return. The first is to limit the scope of agency sales agencies. At this stage, only trust companies, commercial banks, insurance companies, and securities companies are allowed to sell trust products as agents. Other institutions and individuals are prohibited from selling trust products in disguised form. The second is to strictly enforce risk disclosure requirements. Trust documents are required to prominently disclose the risks and risk-taking principles of trust products. For trust products that intend to invest in other asset management products, the investment strategy and risk-return characteristics of the underlying asset management products must be clearly explained. The third is strict sales management. Trust companies are required to strengthen sales channels, documents and personnel management, and clarify responsibilities with sales agencies. Clarify the prohibited behaviors of trust companies and sales agencies during the product sales process. Fourth, adhere to the principle of risk matching. Trust companies should classify the risk levels of trust products one by one and clarify the range of investors suitable for sale;
Classify risk tolerance levels for ordinary investors, including natural persons, one by one, and sell trust products that match their risk tolerance to investors.
