[The State Administration for Market Regulation issued the "Regulations on the Discretion of Administrative Penalties for Market Supervision and Administration"] On November 4, reporters learned today that the State Administration for Market Regulation issued the "Regulations on the Discretion of Administrative Penalties for Market Supervision and Administration" to make systematic provisions in the form of departmental regulations to standardize the discretionary power of administrative penalties for market supervision. The "Regulations" are based on the current "Guiding Opinions on Standardizing the Discretionary Power of Administrative Penalties in Market Supervision and Management" and upgrade the discretionary rules from normative documents to departmental regulations, which enhances the rigidity and authority of the system. At the same time, the "Regulations" clarify the requirements for the formulation body, formulation procedures, main content, adjustment and application of discretionary benchmarks, and further enhance the scientificity and accuracy of discretionary benchmarks. The "Regulations" divide administrative penalty discretion into five levels: no punishment, reduced punishment, light punishment, general punishment, and severe punishment, and make specific provisions on the applicable circumstances of each level. On the one hand, "minor illegal acts" and "minor harmful consequences" are added as discretionary circumstances for mitigating administrative penalties; on the other hand, "using violence and threats to hinder administrative law enforcement personnel from performing their duties in accordance with the law" and "refusing to correct illegal acts" are clearly included in the severe punishment circumstances to ensure that leniency and severity are balanced, excessive penalties are proportionate, and political effects, legal effects, and social effects are unified.
