Abstract:
Dongyang Hiile Film and Television, the investor in "The Legend of Ba Qing", recently issued an open letter seeking recovery of 67 million yuan in investment funds involved in the show, and named Fan Bingbing and her younger brother Fan Chengcheng. Fan Bingbing subsequently entrusted a lawyer to issue a statement, emphasizing that corporate liability and personal liability should be distinguished in accordance with the law.
This dispute originated from the 2017 joint venture between Fan Bingbing's Wuxi Aimeishen and Dongyang Hiile Films to film "The Legend of Ba Qing". Since then, the leading actors Gao Yunxiang and Fan Bingbing have been involved in sexual assault cases and tax turmoil, and there has been no set time for the series to be aired.
The Beijing High Court previously made a final judgment, ordering Wuxi Aimeishen to return 67 million yuan of investment principal and income. The verdict will be handed down in September 2021. Heile Film and Television stated that it has not received the payment so far, and on the evening of September 24, it released a message titled "Ms. Fan, please pay back the money!" 》An open letter.
The open letter also alleged that Wuxi Aimeishen delayed repayment on the grounds of bankruptcy, but transferred more than 200 million yuan to the studio under Fan Bingbing's name and nearly 10 million yuan to Fan Chengcheng's studio between 2018 and 2020, and conducted equity transfers. Haile Film and Television requires the two to come forward to explain themselves and repay the money they are seeking. These capital transactions and claims for accountability are all stated by investors in their open letters.
Zhang Qihuai, a lawyer appointed by Fan Bingbing and Wuxi Aimeishen, issued a statement stating that corporate and personal responsibilities should be distinguished, and joint and several liability must be recovered in accordance with the law. The statement requires relevant remarks to be based on objective evidence, and advocates resolving disputes through legal means such as litigation; for behaviors such as leaking trade secrets, damaging reputation or goodwill, the statement said that they will be held accountable in accordance with the law.
