Nintendo, which claims to have the strongest legal department, has always turned a blind eye to Switch emulators, but this situation has changed. Nintendo recently filed a new lawsuit against the developer of Switch emulator yuzu. The document states that the technology illegally bypasses Nintendo's software encryption and facilitates game piracy.
Nintendo's lawsuit states that "The Legend of Zelda: Tears of the Kingdom" was downloaded more than a million times before its official release. Additionally, yuzu’s Patreon support has doubled during this time.
It is alleged that the developers of yuzu obtained Switch games through hacking methods, which violates the Digital Millennium Copyright Act (DMCA). The team then made a copy of each Switch game, which constituted infringement. Additionally, while not directly related to the crime, Nintendo said fans looking forward to The Legend of Zelda: Tears of the Kingdom were exposed to spoilers.
The argument here is that Nintendo believes Yuzu's business model contributes to the spread of piracy. The company is seeking damages for the alleged breach and wants the emulator shut down.
As we all know, Nintendo has taken various measures to pursue legal liability related to piracy over the years. However, it is still unknown whether there will be any progress on this latest case.
