Abstract:
Recently, a new management rule issued by a community in Nanping, Fujian Province triggered a large number of discussions among netizens. The community directly banned all new energy vehicles from entering underground garages. Many new energy vehicle owners who had purchased the right to use underground parking spaces were instantly trapped in the embarrassing situation of buying parking spaces but not being able to park normally.
Mr. Zhang, a resident of the community, publicly reported that he had previously spent money to obtain the legal right to use the underground civil air defense parking space in the community for 20 years. He has been parking his new energy vehicle in this fixed parking space for the past two years, and has never experienced any abnormal conditions during use. However, not long ago, the property management of the community suddenly posted an official notice stating that all new energy vehicles are not allowed to drive into the underground garage. The parking space he bought with money cannot be used normally.
After the incident,
Mr. Zhang immediately went to the community property management to ask for an explanation. The reason given by the other party for the ban was simple and rude. He was worried that new energy vehicles would explode when parked in the basement. For fire safety reasons, they simply refused to allow entry.
Mr. Zhang later tried to report his reasonable demands through the 12345 government affairs hotline. The official reply he received was that if he had any objections to this regulation of the community, it was recommended to safeguard his rights through judicial channels.
The person in charge of the property management of the community also responded that this regulation is a formal resolution made by the property owners committee of the community through voting at the owners meeting. After the resolution was promulgated, the staff also came to collect the signatures and consents of many owners. The property management itself does not have the authority to formulate or modify such management rules on its own and can only implement them in full accordance with the formal decisions of the property owners committee.
This blanket ban on all new energy vehicles entering basements has also aroused collective opposition from experts in the automotive industry and the legal community. Many scholars have publicly stated that this simple and crude management method is completely undesirable and is essentially an unreasonable regulation born of lazy political thinking.
Zhu Xichan, a professor at Tongji University School of Automotive and director of the Automotive Safety Technology Research Institute, clearly pointed out that the core difference in the potential fire safety risks of new energy vehicles comes from whether the fire protection measures in the basement are in place, rather than the uncontrollable safety hazards of the vehicle itself. Directly banning the vehicles is completely evasive.
Guo Yang, vice president of the Civil Procedure Law Research Association of the Shaanxi Provincial Law Society, believes that this kind of warehousing restriction specifically for new energy vehicles has been suspected of discriminating against specific consumer groups and does not itself comply with regulations.
Many professional lawyers have also given clear legal opinions on this incident. This complete and blanket ban on all new energy vehicles entering the basement directly infringes upon the legitimate parking rights and interests of owners who have purchased parking space rights. Owners whose rights and interests have been damaged can file a lawsuit in the court, requesting the court to determine that this unreasonable resolution of the property owners committee is invalid and safeguard their legitimate rights and interests in accordance with the law.
