Either don’t use tools or hand over content? Meta’s new terms spark controversy

📅 2026-10-17

Abstract:

Gizmodo reports that social giant Meta has updated its Meta Business Suite commercial account terms of service, and the new rules will be officially implemented on October 30. As long as an enterprise uses a Meta business account to carry out advertising and store operations, it is regarded as tacitly allowing the Meta crawler to crawl the public web content of its official website for use in Meta AI large model training. This clause has caused huge controversy in the industry.

According to the new agreement, when a company opens a Facebook or Instagram business account, it automatically grants Meta the right to crawl the public content of its own website, and there is no independent exit channel. Even if the corporate website blocks web crawlers through robots.txt rules, it cannot prevent this content collection based on the authorization of the commercial account agreement.

In the past, Meta needed to sign a separate copyright licensing agreement if it wanted to use publishers and corporate webpage materials to train AI. This change to the terms binds content authorization to the qualification to use commercial tools. Many legal practitioners said that when opening commercial promotion accounts, a large number of small and medium-sized enterprises do not read lengthy service agreements carefully and complete content authorization without knowing it.

Meta explained that capturing web content aims to improve the accuracy of Meta AI’s answers. Since companies use the platform’s commercial services, they should open up the right to use web content. However, publishers and small and medium-sized enterprise industry associations have criticized this, believing that the new regulations force companies to choose one of two options: either give up Meta commercial marketing tools, or hand over website content for AI training, bypassing the normal copyright negotiation process and harming the rights and interests of content owners.
